At long last, the Federal Reserve has finalized the new requirements for the early Truth in Lending disclosures, with the new rules going into effect on the July 30, 2009 due date that was set under the Mortgage Disclosure Improvement Act. When you refinance a loan secured by the customer's principal residence, it could be subject to Section 32 (HOEPA) and Section 35 (higher priced mortgage loans) of Regulation Z. If, however, you can accomplish the refinancing with a loan modification agreement instead, those sections of Regulation Z as well as the disclosure sections do not apply. If your institution is not utilizing loan modification agreements, you should consider doing so.
